These Terms constitute a legally binding agreement between you and Foreclosure Gold, LLC ("Company," "we," "us," or "our"). By creating an account, accessing the platform, or purchasing any leads or services, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with all applicable laws and regulations.
Foreclosure Gold, LLC provides a digital platform and related services for the purchase and delivery of real estate lead data, including but not limited to foreclosure leads, pre-foreclosure leads, mortgage leads, bankruptcy leads, tax lien leads, REO and bank-owned property data, probate leads, and debt settlement leads. We also offer ancillary marketing services including direct mail campaigns, website design, social media management, email marketing, and video production.
Lead data is sourced from publicly available records, opt-in forms, and licensed third-party data providers. We make no guarantee that any specific lead will result in a closed transaction or successful contact.
To access the platform, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
Lead data purchased through our platform is licensed to you for your own internal business use only. You agree that you will:
You acknowledge that you are solely responsible for your use of lead data and any consequences arising therefrom. Foreclosure Gold, LLC shall not be liable for any claims, penalties, or damages arising from your misuse of lead data.
Access to lead data is provided on a credit-based system. Credits must be purchased in advance and are non-refundable except as expressly stated in these Terms. Pricing is subject to change with reasonable notice. All purchases are final. In the event of a billing error, you must notify us within 30 days of the transaction date.
We strive to provide accurate and current lead data. However, we do not warrant that any lead data is complete, accurate, or up to date. Credits may be issued at our sole discretion for leads that are demonstrably invalid (e.g., disconnected phone numbers, invalid addresses) when reported within 7 days of purchase and with supporting documentation. We do not issue refunds based on inability to contact a prospect or failure to close a transaction.
All content, software, designs, text, graphics, and data on our platform are the proprietary property of Foreclosure Gold, LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without our express written permission. The Foreclosure Gold name, logo, and brand marks are trademarks of Foreclosure Gold, LLC.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, FORECLOSURE GOLD, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Foreclosure Gold, LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, your violation of any applicable law or regulation, or your use or misuse of any lead data purchased through the platform.
These Terms shall be governed by the laws of the State of California without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through binding arbitration in Orange County, California under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services immediately ceases. Unused credits at termination are non-refundable unless termination was caused by our material breach.
