1. Lead Data Licensing

All lead data sold by Foreclosure Gold, LLC is provided under a limited, non-exclusive, non-transferable license for your internal business use only. You do not acquire ownership of the underlying data. This license is granted solely for the purpose of identifying and contacting prospects in connection with your lawful real estate, mortgage, legal, or financial services business.

The license granted herein does not permit you to:

• Resell, rent, lease, sublicense, or otherwise transfer lead data to any third party
• Combine lead data with other data sources and redistribute the combined dataset
• Use lead data to build or enhance a competing lead database or data product
• Use lead data for any purpose other than direct outreach for legitimate business purposes

Data Integrity Seeding & Anti-Redistribution Policy

Foreclosure Gold, LLC employs a proprietary data seeding program to protect the integrity of all lead data delivered through our platform. All data sets sold or exported through our platform are embedded with unique, randomized seed records that are invisibly and specifically tied to each individual customer account. These seed records are indistinguishable from standard lead records and are monitored on a continuous basis.

In the event that any lead data purchased through our platform is found to have been redistributed, resold, published, shared, uploaded, or otherwise made available to any third party — with or without financial compensation, and through any medium including but not limited to websites, databases, data exchanges, file-sharing services, or direct transfers — the origin of that data can and will be traced back to the specific customer account from which it was originally purchased.

WARNING: Any customer found to have redistributed Foreclosure Gold data without prior written consent from Foreclosure Gold, LLC will be held fully liable for data theft and unauthorized distribution of proprietary commercial data. Foreclosure Gold, LLC will pursue all available civil and criminal remedies to the fullest extent of the law, including but not limited to claims for actual damages, statutory damages, lost profits, disgorgement of any revenues generated from the unauthorized use, injunctive relief, and attorneys' fees and costs. All offenses will be reported to the appropriate law enforcement authorities.

By purchasing or accessing any lead data through our platform, you expressly acknowledge and agree to this policy. Ignorance of this seeding program shall not constitute a defense to any claim arising from unauthorized redistribution.

2. Data Accuracy and Limitations

Lead data is compiled from public records, opt-in forms, and licensed third-party sources. While we take reasonable steps to verify data accuracy and currency, we make no warranty or representation that:

• Any lead record is accurate, complete, or current at the time of purchase
• Any prospect is currently in financial distress or actively seeking services
• Contact information provided will result in a successful connection
• Any lead will convert to a client, customer, or transaction

Lead data is provided for prospecting purposes only. Conversion rates depend entirely on your outreach strategy, team quality, market conditions, and the nature of your offer.

3. Compliance Obligations

You are solely and exclusively responsible for ensuring that your use of lead data complies with all applicable laws, including without limitation:

• Telephone Consumer Protection Act (TCPA): You must have a lawful basis for any telephone or text message outreach, including proper consent where required
• CAN-SPAM Act: All email communications must include accurate sender information, a clear subject line, and an unsubscribe mechanism
• Fair Debt Collection Practices Act (FDCPA): If applicable to your business, you must comply with all provisions governing contact with debtors
• Do Not Call Registry: You are responsible for scrubbing lead lists against federal and state Do Not Call registries prior to telephonic outreach
• State-Specific Laws: You must comply with all state privacy, consumer protection, and marketing laws applicable to your jurisdiction and the jurisdiction of each prospect
• Real Estate Licensing Laws: You are responsible for ensuring that your use of lead data complies with applicable real estate licensing requirements in your state

Foreclosure Gold, LLC provides no legal advice and makes no representations regarding the legal permissibility of any specific outreach method in any jurisdiction. We strongly recommend consulting qualified legal counsel before conducting any outreach campaign.

4. Credit Purchase Terms

Lead-buying credits are purchased in advance and applied to your account balance. The following terms apply to all credit purchases:

• Credits are non-refundable except as expressly provided in our refund policy
• Credits do not expire while your account remains active and in good standing
• Credits have no cash value and cannot be transferred to another account
• Credit pricing is subject to change with 30 days' notice to active account holders
• Promotional credits issued as bonuses or incentives may have separate expiration terms

5. Credit Refund and Dispute Policy

We are committed to data quality. Credit adjustments may be considered in the following circumstances:

• The lead record contains a phone number that was disconnected or invalid at the time of purchase, as verified by our quality team
• The address on the lead record is demonstrably invalid or non-existent
• The same lead record was sold to you more than once within a 90-day period

To request a credit adjustment, you must submit a support ticket within 7 calendar days of the lead purchase, including the lead ID, specific reason for the dispute, and supporting documentation. We do not issue credit adjustments based on inability to reach a prospect, refusal to engage, or failure to close a transaction. All credit adjustment decisions are made at our sole discretion.

6. Marketing Services Terms

For clients engaging us for ancillary marketing services including direct mail, website design, social media management, email marketing, or video production, the following additional terms apply:

• All service engagements require a signed scope of work or service agreement prior to commencement
• Deposits paid for marketing services are non-refundable once work has commenced
• You are responsible for providing accurate information, brand assets, and timely approvals
• We retain the right to display completed work in our portfolio unless otherwise agreed in writing
• Final deliverables become your property upon full payment of all amounts due

7. Direct Mail Campaign Terms

Direct mail campaigns are offered on a cost-per-call basis where applicable. The following specific terms apply:

• Minimum campaign commitments apply and will be specified in your campaign agreement
• Call volume guarantees are subject to market conditions and list availability
• You are responsible for staffing your phones during agreed campaign hours
• Unanswered calls during your scheduled hours are not eligible for credit
• Campaign creative and data selections require your approval prior to mailing

8. Account Suspension and Termination

We reserve the right to immediately suspend or terminate your account and access to our Services without notice if we determine, in our sole discretion, that you have:

• Violated these Terms and Conditions or our Terms of Service
• Used lead data in a manner that violates applicable law
• Engaged in fraudulent, deceptive, or abusive conduct
• Attempted to resell or redistribute lead data without authorization
• Filed a fraudulent chargeback or payment dispute

Accounts terminated for cause forfeit any remaining credit balance without refund.

9. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared in connection with the business relationship, including pricing, data sourcing methods, and campaign strategies. This obligation survives termination of the business relationship for a period of two years.

10. Entire Agreement

These Terms and Conditions, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and Foreclosure Gold, LLC with respect to the subject matter herein and supersede all prior agreements, representations, and understandings.
